Terms of Service

These Terms of Service ("Terms") govern your access to and use of the products, services, and website provided by Canaria Inc.("Canaria," "we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing our website, requesting data samples, purchasing data products, or using our API, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. If you do not agree to these Terms, you must not use our services.

2. Description of Services

Canaria provides job market data products and enrichment services, including but not limited to:

  • Structured job postings data collected from applicant tracking systems and job aggregators
  • NLP-enriched fields including skills extraction, salary prediction, SOC classification, seniority classification, and work mode detection
  • Skills and title taxonomy datasets
  • Company firmographic data
  • Custom data extracts and sample generation
  • Data delivery via CSV, Parquet, S3, GCS, Snowflake, SFTP, and marketplace channels

3. Account and Access

Access to our data products may require API keys, delivery credentials, or account credentials provided by Canaria. You are responsible for:

  • Maintaining the confidentiality of your API keys and access credentials
  • All activity that occurs under your account or using your credentials
  • Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate access if we reasonably believe credentials have been compromised or Terms have been violated.

4. Permitted Use

Subject to these Terms and your applicable subscription or license agreement, you may use Canaria data products for:

  • Internal research and analytics
  • Internal business decisions, including workforce planning, competitive analysis, and market research
  • Integration into your own products and services (subject to your license tier)
  • Academic research and publication (with attribution)
  • Training machine learning models for internal use

5. Prohibited Use

You may not:

  • Resell, redistribute, or sublicense raw Canaria data without substantial transformation or value-added processing
  • Use our data to build a competing job market dataset or data enrichment service
  • Scrape, crawl, or programmatically access our website beyond the intended use of our services
  • Attempt to reverse-engineer our enrichment models, taxonomy, or deduplication methodology
  • Use our data in any way that violates applicable laws or regulations
  • Remove or alter any proprietary notices, labels, or attributions in the data
  • Share access credentials with unauthorized third parties

6. Data Licensing

Canaria grants you a non-exclusive, non-transferable, revocable license to use the data products you have purchased or subscribed to, subject to the terms of your applicable license agreement. This license does not transfer ownership of the data or any intellectual property rights to you.

The scope of your license (including permitted redistribution, volume limits, and use cases) is defined in your individual subscription or purchase agreement.

7. Payment Terms

Payment terms are specified in your individual subscription or purchase agreement. General terms include:

  • Invoices are due within 30 days of issuance unless otherwise agreed
  • Subscription billing occurs on the agreed-upon cycle (monthly or annually)
  • All fees are non-refundable except as described below
  • Refunds may be issued within 30 days of initial purchase if the data does not materially match the specifications agreed upon
  • Late payments may incur interest at the rate of 1.5% per month or the maximum rate permitted by law, whichever is less

8. Intellectual Property

Canaria retains all rights, title, and interest in and to our data products, enrichment models, skills taxonomy, SOC classification methodology, salary prediction models, deduplication technology, website content, trademarks, and all other intellectual property.

Nothing in these Terms grants you any right to use Canaria trademarks, logos, or branding without our prior written consent. You may reference Canaria as a data source with appropriate attribution.

9. Warranties and Disclaimers

Canaria provides data products on an "as is" and "as available" basis. While we strive for accuracy and completeness, we do not warrant that our data is error-free or that our services will be uninterrupted.

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, Canaria shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of our services.

Our total aggregate liability for any claims arising under these Terms shall not exceed the total fees paid by you to Canaria in the twelve (12) months preceding the claim.

11. Termination

Either party may terminate a subscription or license agreement with 30 days written notice, unless otherwise specified in your agreement. Canaria may immediately terminate or suspend your access if you materially breach these Terms.

Upon termination, your license to use Canaria data products ceases. You must destroy or return all copies of data received under the terminated agreement, except as required for legitimate archival or compliance purposes.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in New York County, New York.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. For active subscribers, we will provide at least 30 days notice of material changes via email. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms.
